Is Nexplanon in a Lawsuit?

Nadrich & Cohen Accident Injury Lawyers is no longer actively retaining Nexplanon victims.

Is Nexplanon in a Lawsuit?

Merck, the makers of the birth control implant known as Nexplanon, is facing lawsuits alleging that the implants have caused blood clots which can lead to potentially fatal complications like:

  • Stroke
  • Heart attack
  • Deep vein thrombosis
  • Pulmonary embolism

Nadrich & Cohen is actively representing victims of Nexplanon who have developed blood clots after having the device implanted. We have been successfully representing victims of defective medical devices such as Paragard IUDs and Philips CPAP machines for over 30 years. We have recovered hundreds of millions of dollars for our clients since 1990.

What Is Nexplanon?

Nexplanon is a birth control implant containing progestin. The device is the size of a matchstick and is implanted just under the skin of the arm. Tiny amounts of etonogestrel, or synthetic progestin, are slowly released by the implant.

The etonogestrel increases the cervical mucous thickness. This reduces the ability of sperm to enter the uterus.

The implant also makes ovulation more difficult, so even when sperm manages to enter the uterus, there probably won’t be an egg there to get fertilized.

Less than one in 100 of those implanted by Nexplanon will end up becoming pregnant.

Does Nexplanon Cause Blood Clots?

A 2012 study found that there was a 40 percent increase in the risk of developing venous blood clots associated with the Nexplanon birth control implant, which is a small, thin rod which is implanted into the arm.

The Nexplanon label received an update in August 2015 warning that serious blood clot-related events have been reported involving those who have received Nexplanon implants. These events, some of them fatal, included deep vein thrombosis, heart attack, stroke, and pulmonary embolism.

What Do Nexplanon Lawsuits Allege?

Nexplanon lawsuits allege that the Nexplanon implants are defective by design because they can cause blood clots even when they are manufactured and implanted correctly. The lawsuits also allege that Merck knew or should have known about this risk, yet failed to warn the public about the risk.

California law allows for those injured by products that are defective by design to recover financial compensation for their injuries from those who manufactured, distributed, or sold the products. California law also allows for those injured by products to recover financial compensation for their injuries from companies who knew or should have known the products were dangerous yet failed to warn about the danger.

What Can I Recover Financial Compensation for in a Nexplanon Lawsuit?

If you have suffered from a blood clot after receiving a Nexplanon implant, the blood clot has probably caused you to incur significant medical bills to treat your blood clot and any complications arising from it.

Your blood clot, any complications arising from it, and any medical treatments necessitated by it may be painful and cause significant emotional distress. Your blood clot and its consequences may also cause you to miss work, or may have even left you disabled and unable to work long-term.

Fortunately, you can obtain financial compensation for all of this in a Nexplanon lawsuit. California law allows for those injured by defective products such as Nexplanon to recover financial compensation for medical bills, pain, suffering, lost wages, and more.

You will need experienced, expert lawyers like Nadrich & Cohen on your side to be compensated fully for your losses, however, so don’t hesitate to reach out if you or a loved one has suffered from a blood clot after receiving a Nexplanon implant.

Who Would Be Sued in a Nexplanon Lawsuit?

Merck, the manufacturer of Nexplanon, would be the defendant in any Nexplanon lawsuit.

Merck was ranked 71st on the 2022 Fortune 500. It reported $48.70 billion in revenue and $13.05 billion in net income in 2021. Merck can afford to hire very good, very expensive corporate lawyers. Thus, you need seasoned defective medical device lawyers like Nadrich & Cohen, who have been handling similar cases for over 30 years, representing you in court if you want to be able to win a Nexplanon lawsuit.

How Much Do Nexplanon Lawyers Cost?

We don’t charge a fee to represent you unless and until we obtain a recovery. Our fee is a percentage of any recovery we obtain for you. This means that it will cost you nothing out of pocket for us to represent you in a Nexplanon lawsuit.
