  • Eye pain
  • Irritation or itching
  • Red eyes

Health Risks of Contaminated Eye Drops

Contaminated eye drops can result in severe injuries, including the need for surgical intervention and even death.

The primary risk of recalled eye drops is microbial contamination leading to treatment-resistant infections. Contaminated eye drops can contain drug-resistant bacteria, making infections difficult to treat.

There have been four reported deaths linked to infections caused by Pseudomonas aeruginosa through contaminated eye drops.

Keratitis, endophthalmitis, and systemic infections are severe health risks associated with contaminated eye drops.

Partial vision loss is a common long-term consequence of using contaminated eye drops.

Total blindness has been linked to the use of contaminated eye drops, with some cases resulting in permanent vision loss.

The use of contaminated eye drops has led to cases of surgical eyeball removal due to severe infections.

The U.S. Food and Drug Administration (FDA) has previously issued warnings against using some over-the-counter eye drop products due to the risk of eye infections that could lead to vision loss or blindness.

Individuals impacted by contaminated eye drops should stop using the products and seek medical attention, keeping evidence of their injuries.

Liability in an Eye Drop Lawsuit

A lawyer discussing liability in an eyedrop lawsuit with their client.

If you have developed an eye infection after using a recalled eye drop product, you are entitled to financial compensation for your injuries and any other resulting damages. You are entitled to financial compensation for the manufacturer of the eye drops because the eye drops are defective.

If eye drops are contaminated with bacteria, that contamination constitutes a manufacturing defect. Under California law, drug manufacturers are financially liable for any injuries caused by defective drugs.

Call us today for a free consultation if you or a loved one developed serious complications from an eye infection caused by a recalled eye drop product. We can help you recover compensation for your injuries and any other damages caused by defective eye drops.

How to Start an Eyedrop Lawsuit in California

You might be entitled to financial compensation if you or your loved one developed an eye infection from a recalled eye drop product. The steps to start filing your eye drop lawsuit in California are:

1. Consult with an Eye Drop Lawyer

Your first step is consulting with a eye drop lawyer with experience handling dangerous drug and product liability cases, a lawyer like the attorneys at our firm. Your lawyer can assess your situation, explain any legal options you have to you, and guide you regarding how you can proceed.

2. Evidence Gathering

Evidence proving your use of recalled eye drops is essential to include in your claim.

Your attorney will require evidence in order to support your lawsuit. This evidence may include medical records, receipts, prescription records, as well as correspondence with the manufacturer of the eye drops.

3. Identify All Liable Parties

Your attorney will assist you by identifying all parties liable for your injuries. These parties may include the manufacturer of the eye drops, the distributor or the doctor who prescribed them.

4. File a Lawsuit

Your attorney will file a civil lawsuit which will outline details surrounding your injuries and seek financial compensation.

5. Settlement Negotiations

Many times, the parties responsible in dangerous drug lawsuits will offer settlements to avoid paying expensive legal fees in a long court battle. Your attorney will perform negotiations with liable parties to make sure you are fairly compensated for any injuries you suffered.

6. Litigation

If your lawyer and the liable parties can’t reach a settlement, your attorney may need to represent you in civil court, presenting your case to a jury or judge.
