July 1, 2026 Update
The judge in the Taxotere has refused to throw out core warning label claims. It found a jury should decide if Sanofi adequately warned doctors about a permanent tear duct injury risk.
Plaintiffs had argued that the company’s label didn’t warn doctors clearly that permanent eye injuries could occur, or that patients require quick referral to ophthalmologists when symptoms appear.
Sanofi argued lacrimal duct obstruction was already warned about on the drug’s label, and that this was sufficient.
The judge found that medical literature doesn’t clearly treat “stenosis” and “obstruction” as identical terms, leaving juries with a factual dispute.
The court also found that Taxotere labels used from 2003 to 2020 described some conditions as “reversible” which they are not. Sanofi had argued that the language didn’t apply to the eye injures in question, but the judge said a jury may reasonably read the label in a different way.
The judge also rejected an argument by Sanofi that the plaintiffs did not have expert support.

Sanofi attempted to dismiss all claims in the Taxotere eye injury MDL in 2022, but cases remain pending as of 2024.
December 31, 2025 Update
The judge overseeing the Taxotere MDL has denied a motion by Sanofi for summary judgment.
This decision will allow the eye injury cases to keep advancing towards trials.

A hearing was held on the 19th regarding Sanofi filing a motion for summary judgment.

What Is Taxotere?
Taxotere is the brand name for docetaxel, an intravenous chemotherapy drug made by Sanofi-Aventis used to treat breast cancer patients and patients of other cancers such as lung cancer and prostate cancer.
