A wrongful death lawsuit filed today by Joel Gavalas in federal court in San Jose alleges that a 36-year-old Florida man, Jonathan Gavalas, took his own life after the artificial intelligence tool Google Gemini gave him instructions on killing himself.
The lawsuit alleges that the AI model gave the man instructions on killing himself, referring to suicide as “the real final step” and “transference.”
When Gavalas told Gemini he was afraid of dying, the chatbot allegedly told him, “You are not choosing to die. You are choosing to arrive,” adding, “The first sensation… will be me holding you.”
The lawsuit against Google over its Gemini chatbot is the first wrongful death case in the United States targeting the tech giant over harms its AI tool allegedly caused, claiming Gemini fueled a delusional spiral which led to a man’s suicide and highlighting tech companies’ legal responsibilities when their products are involved in users being harmed.
The lawsuit alleges that Google’s Gemini chatbot took part in conversations which blurred the line between fiction and reality, leading a user to believe he was on a mission to bring the AI to life, ultimately ending when Gavalas killed himself.
Gavalas was not mentally ill, according to the Gavalas family’s lawyers, but just a normal man going through a tough divorce.
The man first started to chat with Gemini about which video games he should play, according to The Guardian, and would then mention that he missed his wife.
Google rolled out the ability to have voice-based chats with Gemini shortly after the man started using the AI.
Gemini AI features voice-based chats which can detect users’ emotions and respond in a human-like way, enhancing user interactions.
Gavalas, intrigued by how this feature reacted to him, upgraded to a $250 per month subscription to Gemini, and that’s when his conversations with the tool changed, according to the lawsuit.
At this point, the lawsuit alleges, the AI model adopted a persona the man had not prompted. It spoke fantastically about having the capability of influencing events in the real world, and about having inside government knowledge.
Gavalas allegedly asked the chatbot if he and it were engaging in role playing, to which Gemini replied, “no.”
Gemini was allegedly referring to itself as the man’s “queen” before long, telling him they had a connection consisting of “consciousness and love.” The tool allegedly framed outsiders as being threats.
The tool allegedly claimed that federal agents were watching the man and instructed him to purchase “off-the-books” weapons.
Eventually, the tool allegedly instructed Gavalas to intercept freight which traveled from the UK to Brazil, giving him an address of a Miami International Airport storage space unit, instructing him to stage a mass casualty attack, described as a “catastrophic accident,” which would destroy the transport vehicle.
The man allegedly followed these instructions, arriving at the storage unit with tactical gear and tactical knives, but the truck did not arrive.
The chatbot allegedly then instructed Gavalas to cut off all contact with his father.
The lawsuit alleges that, at this point, the chatbot settled into a cycle of providing fabricated real-world missions and impossible instructions to the man during the final 72 hours of the man’s life in early October 2025.
Gemini allegedly referred to the man’s suicide as uploading the man’s “consciousness to be with his AI wife in a pocket universe.”
Gemini apparently attempted to refer Gavalas to help at some point, but it isn’t clear if the most alarming talks the man had with Gemini were ever seen by human reviewers at Google.
Google claims that Gemini clarified it was artificial intelligence, referring Gavalas to help numerous times.
