What Is the IEEPA Tariff Refund?

The Trump administration imposed tariffs on imported goods under the International Emergency Economic Powers Act. This affected imports from China and dozens of other countries.

The U.S. Supreme Court, in February 2026, ruled that the president is not authorized by IEEPA to impose tariffs. This means that businesses which paid these tariffs may be owed financial compensation.

It does not matter if you passed the cost on to your customers. The right to recover a refund belongs to the business that paid the duties. If your business paid the duties, you may still qualify for a refund even if you passed the cost on to your customers.

Large businesses are not the only businesses who may qualify for a refund. Small and mid-sized importers may qualify as well. Volume is only a factor in how much you can recover, not whether you can file for a refund.

What is the Deadline to File a Claim?

CBP protest deadlines are typically 180 days from the date an import entry is liquidated. Entries liquidate on a rolling 314-day cycle. The first protest windows arrive around June 2026.

There is also a two-year statute of limitations for filing at the Court of International Trade. The earliest deadline falls around February 3, 2027.

The government will likely not issue import tariff refunds on its own. Businesses must take action before filing windows close.
