Discord Lawsuit Updates
June 3, 2026 Update
Texas is now heading toward a June 5 hearing regarding it seeking a temporary injunction. The hearing will come after Texas sued Discord on May 22 and secured an emergency Temporary Restraining Order that was announced on May 29.
The push for enforcement parallels a growing wave of lawsuits that claim Discord allows for commercial sexual exploitation and predatory grooming.
These interventions at the state level are providing momentum for lawsuits that seek to bypass defenses based on Section 230 by going after defective product design instead of user-generated content.
May 29, 2026 Update
Texas Attorney General Ken Paxton secured an emergency Temporary Restraining Order against Discord.
The order forces Discord to immediately cease defaulting the accounts of Texas children to its weakest safety settings, as well as to cease marketing itself as “safe by design” while children are allegedly left exposed to predators by those defaults.
Paxton, in a press release, described Discord as designing “a predator’s paradise,” switching its safeguards off by default, and calling it safe. Paxton described this as “evil dressed up as a safety policy.”
The order requires Discord to reconfigure four default settings for all accounts in Texas:
- Blocking sensitive content instead of just blurring it
- Disabling all friend requests
- Disabling direct-message social permissions
- Filtering all spam
The court has barred Discord from telling Texas consumers, whenever these claims are inconsistent with how Discord actually operates, that:
- Discord is “safe by design”
- Discord is “safe by default”
- Safety is “at the core of everything” it does
- That Discord enforces a “zero-tolerance policy”
Discord must now also suspend user violation records’ automatic 90-day expiration, and preserve all moderation and enforcement data. It must also now file a verified report within 14 days which discloses its true default settings, how much of its workforce is devoted to safety, and data regarding how easy it is for banned users to return.
May 22, 2026 Update
Discord, Inc. has been sued by Texas Attorney General Ken Paxton.
The lawsuit alleges that Discord allows predators to exploit and groom children while deceiving the public, parents and consumers about its platform’s safety.
A press release by Paxton alleges Discord lied when it claimed that safety is “fully integrated into our design process” and “at the core of everything we do.”
The press release claims this has happened while making intentional product decisions which default all account settings towards maximum exposure, staffing its most important safety functions with volunteers who are unpaid, and building a platform which has been described by federal prosecutors as “a hunting ground” to sextort, manipulate and find our most vulnerable.
Paxton said that Discord has invited and allowed evil and “nihilistic violence,” and that the lawsuit is intended to protect children from predators.
The lawsuit seeks to require that Discord:
- Default new accounts’ safety settings to maximum protection
- Implement age verification
- Pay back any revenue derived from unlawful conduct
