Financial Compensation Available in Paraquat Lawsuits
Lawsuits allege that exposure to paraquat leads to an increased risk of developing Parkinson’s disease. If you or a loved one has developed PD after being exposed to the herbicide paraquat, you may be eligible for compensation for the following through paraquat litigation:
Medical Bills
PD can be a very costly disease. Not only is it incurable, but it is also progressive, meaning its symptoms only get worse over time. Those diagnosed with PD face a lifetime of treatment, and this treatment can be expensive. You may already owe money in medical bills related to a PD diagnosis. In addition, you’ll almost certainly require future treatment for PD which will generate yet more bills. We can help you recover financial compensation for all past and future medical expenses related to your PD diagnosis.

Lost Wages
Your PD may have caused you to miss time from work. You may have also had to take time off from work to get your PD treated. We can help you recover financial compensation from paraquat defendants for any wages you’re unable to earn due to your PD.
Loss of Earning Capacity
Paraquat is quite dangerous: just a thimble full of it can cause paraquat poisoning. For this reason, it is considered “restricted use” by the Environmental Protection Agency. Unfortunately, some people have been left disabled after exposure to the herbicide. If your PD has left you disabled, this represents a loss or reduction of your earning capacity which we can help you recover financial compensation for.
Pain and Suffering
Unfortunately, the effects of PD can be devastating. If you or a loved one has experienced physical pain or mental suffering due to PD, we can place an accurate value on this pain and suffering and ensure you receive fair, just compensation for it.
Wrongful Death
Unfortunately, the complications of PD can turn fatal. If you have lost a loved one to PD, unfortunately, financial compensation won’t be able to bring your loved one back. However, compensation can make sure the loss of your loved one to PD doesn’t cause your family to experience financial distress.
We can help you recover financial compensation for:
- No longer having your loved one’s spousal benefits, income, love, companionship and household services
- The cost of your loved one’s burial and funeral
- Your loved one’s medical bills, pain and suffering
- The grieving you’ve gone through
- The suffering you’ve gone through
Does Paraquat Exposure Cause PD?
A growing body of evidence links exposure to paraquat with PD. For example, a 2011 study found that paraquat exposure increases the risk of developing PD by 2.5 times.
Lawsuits allege that the herbicide causes PD by inducing the death of dopaminergic neurons.
Dopaminergic neurons are responsible for producing dopamine. The human body requires dopamine for its motor control, or its control over movements. PD is a motor control disorder. The symptoms of PD develop when our bodies fail to produce an adequate amount of dopamine.
Lawsuits allege these neurons are killed by paraquat via a process known as oxidative stress. Our bodies’ cells contain defenses which fight against oxidants. Oxidative stress happens when oxidants in cells and those defenses become unbalanced.
Lawsuits allege that a process called “redox cycling” leads to paraquat creating oxidative stress. The lawsuits allege this process occurs in the presence of oxygen, which is plentiful in the human brain.
The theory is that superoxide radical molecules, which cause oxidative stress, are created by redox cycling, and that once paraquat gets in the brain, redox cycling occurs indefinitely. Lawsuits allege even one molecule of paraquat can lead to the creation of endless superoxide radical molecules.
Why Are Paraquat Dichloride Lawsuits Being Filed?
Lawsuits allege that paraquat manufacturers such as Syngenta and Chevron knew that paraquat can cause PD but failed to warn the public and consumers about this risk. Lawsuits allege that people such as farm workers have developed PD as a result of exposure to paraquat.
A growing body of scientific research links paraquat exposure with PD.
In addition, claims in lawsuits that paraquat manufacturers knew the herbicide can cause PD were bolstered by an expose published by The Guardian in which internal Syngenta documents suggesting manufacturers knew the herbicide is dangerous for a very long time were published.
These documents suggest:
- Syngenta attempted to protect sales of paraquat by trying to refute science which was critical of the herbicide in order to influence regulators.
- Syngenta tried to hide efforts by a scientist who worked to link the herbicide with PD, and tried to stop this scientist from being appointed to an EPA panel.
- Scientists with Chevron and Syngenta predecessor ICI knew in the 60’s and 70’s that the herbicide accumulated in brains.
- Syngenta research demonstrating brain tissue was harmed by the herbicide was withheld from regulators.
- Syngenta scientists were aware the central nervous system was harmed by the herbicide, causing animals to develop PD-like symptoms such as tremors.
- Chevron, in 1975, knew paraquat caused permanent central nervous system effects.
- Scientists with ICI found in 1966 that animals exposed to the herbicide developed PD symptoms like a stiff gait and tremors.
- Meeting notes from Chevron in 1974 mention that occupational exposure to paraquat leads to toxic effects, and a Chevron lawyer, one month later, mentioned evidence suggesting paraquat could cause “industrial injury” leading to millions of dollars’ worth of lawsuits.
- A 1975 meeting involving ICI and Chevron discussed the autopsy of a paraquat poisoning victim involving motor neuron lesions.
- The autopsy of a farmworker was reviewed by ICI in 1976 – the autopsy discovered cell changes in the brain section known as the substantia nigra – a PD hallmark.
- A 1985 memo to Chevron officials mentioned a Canadian study linking paraquat and PD, warning that paraquat could become a legal liability on the scale of asbestos.
- Syngenta, after noting that studies linked paraquat with PD, did its own studies, making sure scientists didn’t measure levels of the herbicide in the brain since detecting paraquat in brains would result in poor optics.
- Syngenta publicized the findings of a study they did which didn’t find that paraquat killed a significant number of dopaminergic neurons in mice, but then failed to publicized the findings of a similar study which found the opposite after its counting method was made more accurate.
When companies know their products can harm others because they are defective and dangerous but fail to warn about this, those injured by the products are entitled to financial compensation for their injuries.

You May Be Able to File a Lawsuit Decades After Exposure
If you have been diagnosed with PD recently and your diagnosis might be related to exposure to paraquat, you’re still eligible to file a lawsuit today despite the exposure to the herbicide occurring years or decades ago.
Every state has a time limit known as a statute of limitations which involves a deadline for filing a civil lawsuit over product liability. Depending upon the state, this time limit can range from one to seven years.
However, that time limit is from the date where the plaintiff becomes aware or should become aware they had a viable claim. For paraquat lawsuits, this means the statute doesn’t start to run until a plaintiff knows or should known they have PD and that the disease could have been the result of paraquat exposure.
PD and paraquat exposure being linked isn’t something a reasonable person is expected to be aware of. This is especially true since paraquat manufacturers intentionally failed to warn the public about the link between PD and paraquat. Most plaintiffs filing paraquat lawsuits are bringing claims based upon exposure which happened quite a long time ago.
If you are unsure if you can still file a claim on time, call us today for a free consultation. We can tell you if you have time to file a claim and answer any other questions you may have.
How Much Is My Paraquat Lawsuit Worth?
As with any other type of personal injury case, it can be difficult to valuate a paraquat claim. Because each situation is unique and each person has a different reaction to paraquat, we have to learn about the unique circumstances you’re experiencing before providing you with solid legal analysis.
The value of your paraquat case will generally depend upon:
The Extent of Contact You Had With Paraquat
Did you drink or eat paraquat in tainted water or food? Did you inhale the herbicide after it was sprayed by your home? Were you exposed to it as a farm worker? What was the quantity of the herbicide you were exposed to? How long were you exposed to it?
How Bad Your Medical Issues Are
PD ends up being different for every person. Do you have any limitations? Are you capable of caring for yourself? Do you require assistance? Do you experience occasional, frequent or constant pain?
How Long You’ll Need to Deal with PD
Those who are exposed to paraquat when they are young and develop PD at a young age will end up dealing with the progressive disease for far more years than older people who are recently exposed.
What Financial Losses Did You Incur?
Are you ending up incurring expenses daily, monthly or annually? Did you lose a job due to PD complications?
Any Mental or Emotional Anguish You Go Through
Are you handling treatment or diagnosis well? Have your family relationships been affected?
