How A Roundup Lawsuit Is Filed
Roundup victims should find experienced lawyers to file Roundup lawsuits for them. It may be virtually impossible to seek a recovery through a lawsuit without the assistance of experienced Roundup lawyers like Nadrich & Cohen.
The steps of filing Roundup lawsuits are:
- Gathering evidence: Our legal team will proceed to gather evidence of your exposure to Roundup, as well as your medical history. With your permission, we can take care of the time-consuming process of recovering your medical records as well.
- Building your case: Our team will gather more evidence, which may include your work history. Our team will do research to figure out if we have represented someone in the past who was affected similarly to you.
- Filing a claim: Once we gather all of the evidence necessary to link your illness to glyphosate exposure, we will make sure a lawsuit is properly filed in the proper court system and in a timely fashion.
Each of these steps needs experienced lawyers to make sure errors aren’t made. Our lawyers and our partners have many decades worth of experience in recovering compensation for those who have been hurt by giant corporations like Bayer.
Do I Need A Roundup Lawyer?
Yes. You need skilled, experienced Roundup lawyers like Nadrich & Cohen by your side in order to sue a large corporation like Bayer. Bayer made about $48 billion in revenue in 2021. Bayer can afford very expensive, powerful defense lawyers.
Qualified Roundup attorneys like Nadrich & Cohen will have the applicable experience and knowledge to navigate complex Roundup lawsuits, build a convincing case for you by gathering evidence, fight for your legal rights and recover for you the most compensation possible.
Roundup lawsuits are product liability lawsuits. In product liability lawsuits, companies are strictly liable for the products they make which are unsafe. Plaintiffs need to be able to prove that those products are defective and cause injuries, though.
The defense will probably deny that your cancer was caused by Roundup. They will hire a very powerful, expensive legal team to disprove that your cancer was caused by Roundup. They have all the resources in the world to fight your claim with. Because of this, you need a lawyer with experience taking on big corporations who sell defective products, a lawyer like the lawyers at Nadrich & Cohen. We have been handling defective product cases since 1990.
Complicated cases such as Roundup lawsuits require enough proof that the defense knew the risks associated with their products and failed to warn consumers about those risks. You would have to know the kinds of evidence which can support your case and the kinds of evidence which are viable in a trial. Experienced lawyers know how to recover any proof needed to win a case.
An additional reason you need to hire a Roundup lawyer is because they are familiar with product liability laws. They know all applicable legal jargon and can explain anything about your case which confuses you so you understand it. It would be a long, time-consuming process for you to have to research all of this information yourself.
The defense is a pharmaceutical giant with billions in revenue. Their legal team will probably intimidate you, especially if you have to speak to them and negotiate with them. A lawyer can take this pressure off of your back and talk to the defense lawyers for you.
Why Are Roundup Lawsuits Being Filed?
Roundup lawsuits are being filed because plaintiffs claim that glyphosate, the active ingredient in Roundup, caused them to end up with NHL or other cancers. Plaintiffs allege that Monsanto, as well as Bayer, failed to warn the public regarding the increased risks of cancer associated with Roundup. Plaintiffs also allege that Monsanto engaged in active deception regarding the safety of Roundup.
During litigation, internal communications of Monsanto’s came up. These communications are known as the “Monsanto Papers.” The documents showed that Monsanto might have hidden the fact for years that Roundup was linked to cancer. These documents allegedly demonstrated evidence that the company had friendly relations with regulators. The documents also allegedly show that Monsanto used other tactics in order to cover up science linking Roundup with cancer.
Does Roundup Cause Cancer?
Since being put on the market in 1974, Roundup has become an essential product for the agriculture industry. American farmers spray almost half a pound of weed-killing chemicals on every acre of cropland each year. When weeds are eliminated, crops have more room to expand, grow and produce a bigger harvest. The power of Roundup is due to its active ingredient – glyphosate. Some studies have shown a Roundup cancer risk for workers who are exposed to large amounts of glyphosate. No one in the agriculture industry doubts the effectiveness of glyphosate, now the most widely used herbicide in the world. After planting with Roundup’s genetically modified seeds, farmers can use the chemical to kill unwanted weeds without destroying their money-making crops. However, more and more scientists are now starting to question the safety of Roundup’s active ingredient. A 2015 report from the World Health Organization found glyphosate to be “probably carcinogenic.” Since then, several Roundup weedkiller cancer lawsuits have been filed against Monsanto on behalf of men and women who have been exposed to Roundup and subsequently received a non-Hodgkin lymphoma diagnosis.
The state of California officially listed Roundup’s glyphosate ingredient as a carcinogen in 2017. For an individual who wants to file a Roundup cancer lawsuit, the Golden State arguably provides one of the friendliest venues. Vince Chhabria, the U.S. District Court Judge in San Francisco, is now presiding over 310 Roundup trials involving cancer victims. The judge has publicly stated that scientific evidence, rather than the stance of the EPA, will determine the outcome of each Roundup cancer trial.
Roundup Weed Killer Cancer
Some studies link Roundup’s chemical formula to non-Hodgkin lymphoma, a condition that affects the lymphocytes in the body’s immune system. Researchers predict that more than 20,000 Americans will die from this form of cancer in 2017. Depending on the individual case, non-Hodgkin’s lymphoma could spread quickly or slowly. Therefore, some agricultural workers may not realize they have the disease for quite some time. Symptoms of non-Hodgkin lymphoma include swollen lymph nodes, fever, night sweats and weight loss.
More than 1,000 agricultural workers diagnosed with non-Hodgkin lymphoma have decided to file and pursue Roundup cancer lawsuits against Monsanto. The EPA’s position that Roundup does not cause cancer in humans remains unchanged. However, many experts have started to question the agency’s testing methods. A secondary review of the EPA’s recent meta-analysis of epidemiological data found that exposed farmers were 27% to 50% more likely develop cancer than participants in the control group.
Factors Which Influence A Roundup Case
It is important to file a claim as soon as you can if you have developed cancer after being exposed to Roundup. Some factors which may impact your case include:
Proof Of Monsanto’s Negligence
Negligence is failure to be reasonably careful to prevent harm. An example of negligence is not testing a product enough before selling it. Plaintiffs will need to prove Monsanto was negligent when they designed Roundup, and that they were harmed because of this negligence. A lawyer at Nadrich & Cohen can help gather proof of Monsanto’s negligence while preparing your case.
Proof That Monsanto Failed To Warn About Roundup’s Risks
Previous Roundup claims against Monsanto alleged that Monsanto failed to warn the public about the risks of exposure to Roundup. They also alleged false advertising and negligence. It has been argued by previous plaintiffs that Monsanto ignored or misinterpreted safety data while making, distributing and selling Roundup. Your claim probably has to be able to prove that Monsanto failed to appropriately warn consumers about health risks associated with Roundup. Your lawyer can help gather evidence to prove this.
Length And Degree Of Exposure To Roundup
Your claim may be stronger if you were exposed to Roundup constantly for a period of multiple years. So, if you were a farmworker where Roundup was used for many hours each time, your case may be stronger than that of someone who merely visited a location once where the herbicide was used.
Proof You Were Exposed To Roundup
You will obviously need proof that you were exposed to Roundup to win a Roundup lawsuit. You will need to gather evidence proving your Roundup exposure, whether that exposure be at home, on a farm or at work. Landscaping invoices, your work’s standard operating procedures, used bottles and purchase receipts can all be important evidence.
Proof That Your Roundup Exposure Caused Your Cancer
You will need scientific evidence which supports your argument that your cancer was caused by Roundup. This is probably the most important evidence necessary to win your case. Your lawyer can help you gather this evidence.
How Much Time Passed Between Your Exposure And Your Diagnosis?
A court may consider how much time passed between your Roundup exposure and the date you were diagnosed with cancer. Lymphoma typically develops over a period of at least two years. So, the court will need to see that enough time has passed between your exposure and your diagnosis to consider it feasible that Roundup caused your cancer.
Health Comorbidities
If you have health comorbidities which can lead to cancer, this can make it harder to win your case. Things that can make it harder to win your case are HIV/AIDS, using immunosuppressants, having a cancer history, being exposed to carcinogens that aren’t glyphosate, and smoking tobacco.
Are you ready to speak with a lawyer to find out if you have a viable case? We can provide you with a free case evaluation which can assist you in determining if you have a viable case, if you need more evidence to build a stronger case, and your next steps. Call us today for a free consultation.
Why Doesn’t The EPA Consider Glyphosate Dangerous?
The EPA, for a long time now, has maintained that exposure to glyphosate, and consumption of low levels of glyphosate, do not pose a risk to people.
Monsanto, on their website, supports this position with their own studies. These studies claim that glyphosate is over ten times less toxic than the commonly-ingested caffeine.
Despite the positions of the EPA and Monsanto, many United States landscapers and farm workers are filing lawsuits against Monsanto. The lawsuits claim that they developed NHL because they were exposed to glyphosate.
Monsanto claims that over 700 studies found that glyphosate is not associated with cancer.
However, during the initial cases involving Monsanto and Roundup, information was obtained showing that EPA reports are probably compromised.
Within this information are email communications involving Monsanto which suggest that Monsanto actually acted as a ghost writer for EPA research which was later approved by academics at the EPA.
In an email, a Monsanto executive wrote that the company could keep costs down by “doing the writing” and that the EPA would simply edit the writing and sign the writing.
Evidence also exists that a senior official with the EPA directly worked with directors at Monsanto to stop investigations done by federal health agencies, investigations into glyphosate’s possible adverse effects.
Yet more documents suggest senior officials in the EPA worked alongside Monsanto to conceal a government study which suggested glyphosate may be carcinogenic.
Roundup has been banned in many locations, including Vietnam, Sri Lanka, Columbia, Bermuda, France and the Netherlands.

Roundup Weed Killer Cancer Lawsuits
Bayer acquired Monsanto on June 7, 2018 and is now legally responsible for paying all Roundup Weed & Grass Killer injury and death claims in Roundup litigation.
Monsanto, the manufacturer of Roundup, has long touted the safety of its product. Before the weed-killer could be sold to farmers, it had to pass muster with the EPA. The heads of Monsanto often point to EPA reports and other studies that indicate that their formula is less toxic than many common substances. Some of these studies, however, have been linked to pro-Roundup consultants. Furthermore, EPA toxicologists actually raised concerns following a Roundup cancer study in 1984. In late 2016, several scientists on an EPA peer-review board questioned the agency’s long-held belief that glyphosate is not significantly carcinogenic.
As a major agricultural corporation that yielded more than $13 billion in revenue in 2016, Monsanto has a lot at stake in the EPA’s assessment of its product. The company has its fair share of government lobbyists who push both Democratic and Republican politicians to pass favorable legislation. When a Monsanto Roundup controversy arises, company spokespeople go on the attack. They have gone to great lengths to point out flaws in the IARC study. The EPA’s report on its peer review also clouds many of the negative concerns raised by outside scientists. Monsanto lobbyists, who are frequent visitors at the EPA’s Office of Pesticide Programs, may have helped sway the more positive report.

Non-Citizens Are Eligible To File Roundup Lawsuits
Reuters has reported that Bayer has been sued for barring someone from a Roundup settlement because the person is not a United States citizen.
Non-citizens are allowed to file personal injury lawsuits in the United States.
Is There A Roundup Class Action Lawsuit?
A Roundup class action lawsuit has been filed. However, many of those who have developed non-Hodgkin lymphoma will be able to recover more money by filing an individual lawsuit rather than joining a class-action lawsuit.
Class action lawsuits are lawsuits on behalf of a large group of plaintiffs who have all experienced very similar damages. In these lawsuits, the specific damages and losses of each individual client are not taken into account. So, if you join a class action lawsuit, you may receive far less money than the amount of money you have lost due to your illness.
By filing an individual lawsuit instead, you can make sure that your individual medical bills, lost wages, loss of earning capacity and more are factored into any settlement or award you ultimately receive. This may significantly increase the amount of compensation you qualify for.
Call us today for a free consultation if you are unsure if you should join a class action lawsuit or file an individual lawsuit. We can file an individual lawsuit for you or we can help you join a class action lawsuit. We can explain the advantages and disadvantages of each for you and how they relate to your individual circumstances. Call us today for a free case evaluation.
Can I File A Lawsuit Against My Employer After Using Roundup At Work?
You may be able to. One thing experienced injury lawyers like Nadrich & Cohen do for their clients is find every single possible source of financial recovery for their clients to maximize the size of their recovery. If you used Roundup or a product which contains glyphosate at work, you might be eligible for a claim filed against whoever employed you.
When employers require employees to use Roundup, they have to provide their employees with safety gear. This might include gloves, face masks or other gear. If you weren’t provided with this gear by your employer, or if your employer didn’t give you safety training, you may be able to sue them over your cancer.
This would be a separate claim than a claim filed against Bayer, and it’s OK to file both. However, double-dipping can’t happen: if you end up recovering money for lost wages from your employer, you cannot then also end up recovering money for lost wages from Bayer. Also, if you file for worker’s compensation, you can’t then also file a lawsuit against your employer seeking damages.
Call us today for a free consultation to find out if suing more than just Bayer is a good idea for your individual circumstances. It may be, and it may not be. We can help answer this question for you.
Can I Still File A Lawsuit After The Roundup Settlement?
Bayer may have already reached an 11-digit settlement with Roundup victims. However, Roundup is still being sold. Thus, new Roundup cases are likely to pop up.
Two types of Roundup lawsuits haven’t been filed yet:
- Cases involving old diagnoses
- Cases involving NHL diagnoses in the past three years
Recently diagnosed NHL diagnoses make for extremely viable Roundup lawsuits.
The Roundup lawyers at Nadrich & Cohen are of the belief that new cases will probably involve much larger settlement amounts per-person than the Roundup cases which already settled. Why is this? It’s because while Bayer has already reached an 11-digit settlement with Roundup victims, they are still selling Roundup.
Bayer has clearly decided that it will be more profitable for them to simply keep selling Roundup and pay off new claims than to stop selling Roundup. This will look absolutely terrible for Bayer in front of juries. For this reason, we expect the next round of Roundup settlements to be much larger than the previous round.
