California Zogg Fire Lawyer

Zogg Fire Lawsuits

Nadrich & Cohen Accident Injury Lawyers is actively retaining Zogg Fire victims. You might qualify for financial compensation if the Zogg Fire injured you or damaged or destroyed your property. You will never be charged a fee if we don’t obtain a recovery for you.

CAL FIRE has determined that the Zogg Fire started when a pine tree contacted electrical distribution lines operated and owned by PG&E. Let us hold PG&E accountable for their actions while we obtain justice for you. Call us today at 877-918-0185 for a free case evaluation. We have already retained thousands of fire victims in the Camp, Kincade, North Bay, Dixie Fire and Fly Fire, all involving PG&E power lines.

PG&E Equipment And The Zogg Fire

PG&E stated in a filing with the U.S. Securities and Exchange Commission that “A PG&E SmartMeter and a line recloser serving [the area where the fire began] reported alarms and other activity between approximately 2:40 p.m. and 3:06 p.m.” The filing states that wildfire camera and satellite data reveal smoke, heat or fire signs in the same area between 2:43 p.m. and 2:46 p.m.

An NBC Bay Area investigation found that “clueless” tree crews left trees standing near power lines in the general area where the Zogg Fire started.

The California Public Utilities Commission has placed PG&E into the first step of enhanced oversight because the company has failed to give adequate priority to vegetation clearance on high-risk power lines.

The Zogg Fire burned 56,338 acres of land, having destroyed 204 structures and killed four people.

How We Can Obtain You A Zogg Fire Recovery

We can obtain for you the largest possible Zogg Fire recovery due to our extensive experience in handling wildfire lawsuits. Our law firms have already filed numerous Kincade Fire lawsuits claiming the fire started because PG&E failed to adequately maintain its equipment and the vegetation around it. CAL FIRE has found PG&E’s power lines responsible for the Zogg Fire, so Zogg Fire lawsuits will seek damages based on similar causes of action to Kincade Fire lawsuits.

You may be eligible for financial compensation based on numerous causes of action, including:

Negligence

One is negligent when they don’t act with the same level of care that a reasonably careful person would act given the same circumstances.  A reasonable utility company would perform proper, adequate and timely maintenance on its equipment and surrounding vegetation. Failing to adequately perform this maintenance in a timely manner is negligent.

Inverse Condemnation

Inverse condemnation refers to a section of California’s constitution, Article One, Section 19, which states that just compensation needs to be paid to the owner of a property which is taken or damaged for a public use. This applies to utility companies in California as well as the government. Therefore, inverse condemnation applies to property which is damaged by a fire started due to a utility company’s negligence.

Premises Liability

Organizations that know or should know a dangerous condition exists on their property and fail to do anything about it are liable in California for damages caused by that dangerous condition. Improperly maintained power lines and vegetation would constitute a dangerous condition.

Violation of Public Utilities Code § 2106

This code essentially states that when a utility company breaks a law, the utility company is liable for any property damage resulting from this unlawful action. It appears the Zogg Fire started because PG&E failed to maintain equipment and vegetation as mandated by California laws and regulations.

Violation of Health and Safety Code § 13007

This code essentially says that anyone who negligently starts a fire is liable for any damages caused by that fire.

Public Nuisance

Any fire that has a negative impact on a large number of people is a public nuisance.

Private Nuisance

It is considered a private nuisance when a fire obstructs the free use of one’s own private property.
