Zimmer Biomet CPT Hip System Associated With Higher Risk of Thigh Bone Fracture
On September 17, 2024, the FDA warned Americans that an increased risk of thigh bone fracture is associated with surgery involving the Zimmer Biomet CPT Hip System Femoral Stem 12/14 Neck Taper.
The warning came after a July 2, 2024 recall of the CPT Hip System’s instructions for use due to the thigh bone fracture risk. Zimmer also announced that it planned to phase out sale of the devices by December 2024. The FDA, however, expressed concerns regarding the CPT Hip System continuing to be used in hip replacement surgeries. The FDA expressed concerned about the thigh bone fracture risk, and the fact that surgical intervention is likely necessary when fracture happens.
According to the UK’s Medicines and Healthcare products Regulatory Agency, while similar PTS hip stems see fracture rates between 0.6 percent to 1 percent, the CPT Hip System is associated with about a 1.4 percent thigh bone fracture rate.
The FDA recommends that patients:
- Discuss the risks and benefits of every available hip replacement device with their healthcare providers
- Know about the higher risk of thigh bone fracture associated with surgery involving the CPT Hip System
- Consult with their healthcare providers if they received CPT Hip System implants and experience unexpected difficulty walking or pain
- Continue with their existing follow-up schedules for their CPT Hip Systems if they don’t experience unexpected symptoms
- Not remove CPT Hip Systems which are well-functioning

Is There A Zimmer Biomet CPT Hip System Class Action Lawsuit?
No class action lawsuit has been filed regarding this device, and our law firm is not filing one. Instead, our law firm is filing individual lawsuits on behalf of those who have suffered thigh bone fractures due to this device.
It is rare for patients with serious injuries to take part in class action lawsuits, and plaintiffs in class action lawsuits typically see much smaller payouts than plaintiffs who file individual lawsuits.
If you have suffered a thigh bone fracture after a hip surgery involving a Zimmer Biomet CPT Hip System, we will file an individual lawsuit on your behalf instead of a class action lawsuit in order to maximize your financial recovery.
How Does a Defective Medical Device Lawsuit Work?
A defective medical device lawsuit is a complicated example of litigation which requires extensive attention to detail and preparation. Each lawsuit is unique. However, basic steps of filing lawsuits against medical device manufacturers like Zimmer include:
Collecting Medical Records
Our team will collect all of your medical records in order to adequately document your injuries’ extent and prove that a medical device defect caused your injuries.
Consulting Medical Experts
We will consult with leading experts in the field of medical devices in order to demonstrate the Zimmer Biomet CPT Hip System’s inherent defects and flaws.
Filing a Lawsuit
We will send Zimmer a demand letter which outlines your injuries as well as the compensation that you are seeking. If Zimmer does not accept this offer, we will file a lawsuit on your behalf in the proper court.
Discovery
This legal phase involves us asking Zimmer for the testing, manufacture and design of the Biomet CPT Hip System. Discovery often uncovers vital internal company testing and documents which demonstrate device manufacturers knew about risks associated with products yet insisted on releasing the products into the marketplace in order to profit.
Mediation and Negotiation
The majority of civil lawsuits are resolved out of court. If it is possible, we will try to negotiate a settlement with Zimmer in order to avoid prolonged, costly litigation.
Trial
If we cannot reach a settlement with Zimmer, we will represent you in court in front of a jury or judge in order to determine the financial compensation you might be entitled to.
Is There a Time Limit to File a Lawsuit?
There is a time limit for you to file a lawsuit after you experienced your thigh bone fracture. This time limit is called a statute of limitations and is different depending upon what state you live in. For example, in California, you have two years from the date that you became aware that your injury was caused by a product defect to file a lawsuit. Failure to file a lawsuit before the time limit expires can forever bar you from recovering compensation for your injury.
We are familiar with the statute of limitations in all 50 states so call us today for a free consultation if you are unsure of whether you are eligible to file a lawsuit. Even if you still have years before the statute expires in your case, it’s still best to call us today as defective medical device lawsuits are very complex and it can take quite a while to gather evidence and put together a convincing case. By calling us today, you will give us the most time possible to build a strong case for you and maximize your financial recovery.
