Do I Qualify for a Lawsuit Against Ford?
You qualify for a lawsuit against Ford if you were injured when one of the recently recalled vehicles rolled while in park.
Under CA Civil Code 1714.45, California law holds vehicle manufacturers strictly liable for any injuries caused by their defective vehicles. This means that it doesn’t matter if the defect was caused by the manufacturer’s negligence or not. June 2022 Ford Recall
Ford vehicles were recently recalled because the bushing attaching the transmission to the shift cable may detach or degrade, preventing the shifter from placing the transmission in the intended gear position. The transmission might not actually be in the park position despite the shifter position indicating that the vehicle is in park.
Drivers do not receive an audible chime or a warning message. Exiting the vehicle when the transmission is not in park while the parking brake is not applied can allow vehicles to roll, increasing the risk of crash or injury.
The root cause of this defect is unknown, although Ford said humidity and heat may contribute to the bushing material hydrologically breaking down. If the vehicle’s ignition state is on, the instrument panel may show the correct gear state of the transmission, which might not match the position of the gear shift lever.
